August 22, 2005:

"In a well thought out opinion, Judge Campbell upheld the Village's setback ordinance for the Rio Grande Boulevard corridor. The Court specifically found that preserving the unique character and scenic beauty of the Village is a proper exercise of the Village's governmental powers".

Mayor Abraham was extremely pleased by the decision and stated:  "This is a tremendous victory for our Village and all of our residents. I am particularly pleased for all of the people that worked so hard on the 2010 Master Plan that identified Rio Grande Boulevard as the essence of our Village."

This issue is very dear to my heart because it is the reason I became active in Village politics. I campaigned on the fact that I was in favor of restoring the setbacks along Rio Grande Boulevard to their original 280' from the centerline of the road. From the beginning I realized that the setback might get challenged.  This is why I was very careful to make certain that the process was followed, that hearings were open to dissenters as well as the advocates and that notice was given in the proper manner. Preserving the vistas and assuring that the 280 foot setback be upheld was key to maintaining our rural character.  I am extremely pleased with the Court's ruling.

This ruling insures for all of our kids and grand kids that the integrity of the Rio Grande corridor will remain one of New

Mexico 's most valued and scenic byways.
